Summary Judgment granted for Mike Blazick and Elizabeth Scoblick for physician in Luzerne County
Recently, the court granted summary judgment in favor
of a doctor who was sued in a medical malpractice action
in Luzerne County, Pennsylvania. In the complaint, plaintiffs
alleged that the doctor failed to timely diagnose and
treat a pelvic abscess and failed to provide proper
follow-up care after a vaginal hysterectomy was performed.
At the close of discovery, and after all expert reports
were submitted, Attorneys Mike Blazick and Elizabeth
Scoblick moved for summary judgment.
Despite the fact that discovery deadlines were stipulated
between the parties and the Court ordered that all discovery
was to be completed by a specified date, plaintiffs
failed to submit any expert report in support of their
claims against the doctor.
Consequently, the court determined that summary judgment
was proper, entered judgment in favor of the doctor
and plaintiffs’ claims against the doctor were
dismissed with prejudice.
