John Hill obtains defense verdict for Surgeon and Community Hospital

John Hill of our Bethlehem Office recently obtained another Defense Verdict for a local surgeon and community hospital after 4 days of trial.

John successfully defended a general surgeon and a community hospital in a medical malpractice action in July where it was alleged that the surgeon and hospital nurses where negligent by prematurely discharging the plaintiff after undergoing a laparoscopic cholecystectomy. Within three days of his discharge, the patient was rushed emergently back to the hospital where a second exploratory surgery discovered a surgical clip had fallen off of the cystic duct and large amounts of bile had accumulated in the plaintiff's abdomen. At trial, plaintiff charged that due to the surgeon's and nurses' failure to appreciate the bile leak, that he had sustained permanent and severe pain and physical limitations.

In defense, John offered compelling cross-examination testimony from the plaintiff which established that he had delayed in contacting the surgeon and/or the hospital when he began to experience post-operative complaints. After 4 days' of trial, a twelve member jury panel returned a unanimous verdict in favor of the hospital and surgeon. Of interest, the jury returned a verdict AGAINST the plaintiff by finding him "100%" responsible for his own injuries.
