Amy Shwed obtains defense verdicts for cardiothoracic surgeon and osteopathic physician in back-to-back trials.

Amy Shwed successfully defended a cardio-thoracic surgeon against an allegation of professional liability with a verdict entered on Sept. 30, 2006. Plaintiffs alleged that the surgeon’s failure to timely operate on him and to provide sufficient blood led to his death. Attorney Shwed presented expert testimony to establish the Plaintiff died as a complication of a stroke. The jury agreed and found in favor of the physician. On October 2, 2006, Attorney Shwed commenced her defense of an osteopathic physician against allegations that the doctor’s cervical manipulation led to a cervical disc herniation and permanent disability. Plaintiff alleged that the osteopathic physician injured her spinal cord during a cervical manipulation. The spinal cord injury left her permanently disabled. Attorney Shwed presented evidence that the Plaintiff’s disability was a result of her previously diagnosed degenerative disc disease and not malpractice. The jury agreed and on October 11, 2006 rendered a defense verdict in favor of the osteopathic physician.
